Professor Emily Jackson asks 'Do doctors know best?'

Professor Emily Jackson’s article “From ‘Doctor Knows Best’ to Dignity: Placing Adults Who Lack Capacity at the Centre of Decisions About Their Medical Treatment” was recently published in the Modern Law Review.

The article examines the advantages and disadvantages of providing additional guidance to those making best interests decisions for adults who lack capacity, under the Mental Capacity Act 2005.  Jackson stresses the importance of taking seriously the wishes of people who lack capacity, while also ensuring that patients who need help are given support.
