Dr Paul MacMahon's work cited in Court of Appeal

Wednesday 15 October 2025

Dr Paul MacMahon's article, 'Compensation After Cancellation for a Seller's Negligent Delay', was recently cited in the Court of Appeal of England and Wales in The Lila Lisbon. The case concerns how to measure damages for breach of contract where a party terminates under an express termination clause. Lord Justice Nugee cited the article four times and quoted it twice, noting that he was 'heartened' that Dr MacMahon's analysis supported the court's conclusion. Another of Dr MacMahon's articles, 'Rethinking Assignability', was cited in 2024 by the Singapore Court of Appeal in DGJ v Ocean Tankers, alongside Professor Michael Bridge's article 'The Nature of Assignment and Non-Assignment Clauses'.
