The primary source of data is the <a class=\"link link--external\" href=\"https:\/\/www.climatecasechart.com\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">Climate Litigation Database&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> maintained by the Sabin Center for Climate Change Law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The<\/strong><strong> report explores developments in the field through five themes<\/strong>:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The continued <strong>maturation<\/strong> of the field as a recognised dimension of global climate governance<\/li>\n\n\n\n<li>Its ongoing <strong>expansion and innovation<\/strong> across new locations, actors and legal theories<\/li>\n\n\n\n<li>The scale and coordination of the <strong>pushback<\/strong> now underway against both climate action, in general, and climate litigation specifically<\/li>\n\n\n\n<li>The growing <strong>complexity<\/strong> of a field increasingly enmeshed in the politics and trade-offs involved in the implementation of climate policy responses<\/li>\n\n\n\n<li>The current state of knowledge about the <strong>implementation and impacts<\/strong> of climate litigation in the real world.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">This report is the ninth in a series. You can find previous years&rsquo; reports&nbsp;<a href=\"https:\/\/www.lse.ac.uk\/granthaminstitute\/litigation\/\"><strong>here<\/strong><\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Core insights<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The authors identify the following key trends for the period January to December 2025:<\/strong><br>&bull; In 2025, 249 new climate cases were filed, bringing the total since 1986 to more than 3,600 cases.<br>&bull; Over three quarters of these cases have been filed since 2015, the year of the Paris Agreement.<br>&bull; Cases have been filed across 62 countries, up from just 17 countries a decade ago. In 2025, cases were newly filed in Grenada, Guatemala, Kazakhstan, Malaysia, Singapore and Zambia.<br>&bull; The United States remains the jurisdiction with the highest number of cases: 151 new cases were recorded in 2025, bringing the total to 2,078.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Maturity<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>State obligations to act on climate change are increasingly being consolidated as a matter of legal duty, not merely political choice. <\/strong>This is observed in: a growing number of decisions made by &lsquo;apex courts&rsquo;: three recent advisory opinions from the <a class=\"link link--external\" href=\"https:\/\/www.climatecasechart.com\/document\/request-for-an-advisory-opinion-submitted-by-the-commission-of-small-island-states-on-climate-change-and-international-law_bb72\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">International Tribunal on the Law of the Sea (ITLOS)&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a>, the <a class=\"link link--external\" href=\"https:\/\/www.climatecasechart.com\/document\/request-for-an-advisory-opinion-on-the-scope-of-the-state-obligations-for-responding-to-the-climate-emergency_fbcd\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">Inter-American Court of Human Rights (IACtHR)&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a>, and the <a class=\"link link--external\" href=\"https:\/\/www.climatecasechart.com\/document\/request-for-an-advisory-opinion-on-the-obligations-of-states-with-respect-to-climate-change_0213\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">International Court of Justice (ICJ)&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a>; and a self-reinforcing cycle of climate litigation operating across domestic, regional and international courts.<\/li>\n\n\n\n<li><strong>Courts are engaging with <em>systemic polluter pays<\/em> cases<\/strong> (seeking damages from companies for contributing to global climate change impacts) and <strong><em>corporate framework<\/em> cases <\/strong>(seeking to develop standards preventing companies from continuing with high-emitting activities), though no case of these types has yet resulted in an order requiring behaviour change or the payment of damages.<\/li>\n\n\n\n<li><strong><em>Climate-washing<\/em> cases, which challenge inaccurate government or corporate narratives about the low-carbon transition, are the most common type of case involving corporate actors<\/strong>. However, claimants appear to be shifting their focus towards cases addressing total inaction.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Expansion and innovation<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The circle of actors involved in climate litigation is widening, <\/strong>with more than 50 strategic climate-aligned cases filed against companies in 2025, spanning energy, finance, transport, real estate and consumer goods. State-owned enterprises and financial institutions are defendants in at least 42 of these cases.<\/li>\n\n\n\n<li><strong>New types of claimants are entering the field, <\/strong>and we have seen the first cases of insurance companies seeking to recover financial losses linked to climate change from governments.<\/li>\n\n\n\n<li><strong>Governmental and quasi-governmental actors are also bringing new types of cases to enforce climate standards across a range of economic activities.<\/strong><\/li>\n\n\n\n<li><strong>Since 2015, there have been more than 249 cases brought seeking compensation for damage to the climate system from activities such as illegal deforestation. <\/strong>Brazil has the largest concentration of such cases.<\/li>\n\n\n\n<li><strong>The next wave of climate litigation cases may emerge in three areas<\/strong>, relating to: carbon dioxide removal and storage infrastructure; emissions from powering large data centres; and the connection between climate change and other environmental problems, such as plastic pollution.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Pushback<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The current moment is marked by the increasing scale, coordination and institutional depth of opposition to climate litigation<\/strong>, especially in the US.<\/li>\n\n\n\n<li><strong>Strategic lawsuits against public participation (SLAPPs) and new legislative interventions <\/strong>are shrinking the civic and judicial space in which climate advocates operate.<\/li>\n\n\n\n<li><strong>The pushback has generated a substantial and growing countervailing wave of protective climate litigation.<\/strong><\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Complexity<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Non-climate-aligned cases reflect the complex trade-offs of the implementation phase of the energy transition.<\/strong><\/li>\n\n\n\n<li><strong><em>Just transition<\/em> and <em>green v. green<\/em> litigation continues to grow, <\/strong>raising questions over the justice and fairness of climate action, and challenging climate policy measures for their alleged impacts on other aspects of the environment, respectively.<\/li>\n\n\n\n<li><strong>Some recent cases demonstrate tensions in the implementation of climate adaptation measures, <\/strong>highlighting potential adaptation&ndash;mitigation trade-offs.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Impacts and implementation<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Climate-aligned judgments do not automatically translate into policy change.<\/strong><\/li>\n\n\n\n<li><strong>There are clear challenges in charting both the anticipated impacts and unintended consequences of positive judicial decisions.<\/strong><\/li>\n\n\n\n<li><strong>Implementing climate judgments requires sustained political will and legal follow-through,<\/strong> as illustrated by recent cases in South Korea and New York State.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n","protected":false},"excerpt":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\"
