Strategic climate litigation targeting companies aims to influence the&nbsp;behaviour&nbsp;not only of the individual firm, but also of its investors and other financial market actors.<\/p>\n\n\n\n<p>Legal scholars and experts have argued that climate litigation can impose material financial costs on companies, even when it does not lead to large direct penalties, for example, through reputational damage, operational disruption, financing conditions and changes in investor expectations.<\/p>\n\n\n\n<p>Yet despite this, little is known about how investors perceive and process climate litigation risks. In this paper, the authors address this evidence gap, providing the first systematic evidence on how investors perceive climate litigation as a financial risk.<\/p>\n\n\n\n<p>Drawing on a global survey of 811 institutional equity investors and analysts, the authors find most investors view climate litigation as a material financial risk. However, investors differ on when they believe it becomes relevant and how it affects companies.<\/p>\n\n\n\n<p><strong>Key points for decision-makers<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Climate litigation is already perceived as a material financial risk.<\/strong> Nearly 80% of investors view climate litigation as at least moderately important, and over 80% expect it to become financially relevant within the next decade. This is not a distant concern for the investment community and it is already responding to this perceived risk.<\/li>\n\n\n\n<li><strong>Financial impact begins long before a court ruling. <\/strong>Investors most commonly point to media coverage and case filing &ndash; not trial outcomes &ndash; as the moment litigation becomes financially significant. Firms face reputational and valuation consequences from the moment a legal case enters public awareness.<\/li>\n\n\n\n<li><strong>Litigation risk extends beyond carbon majors. <\/strong>While carbon-intensive sectors such as fossil fuels and utilities are seen as the most exposed, investors perceive risk across all sectors, including banking, agriculture and retail. This reflects the expansion of climate lawsuits into greenwashing, supply-chain accountability and financial services.<\/li>\n\n\n\n<li><strong>Investors disagree systematically on how climate litigation matters. <\/strong>Three distinct investor profiles emerge &ndash; those largely unconcerned by climate litigation; those focused on regulatory risks; and those focused on litigation and physical climate risks &ndash; reflecting coherent, but divergent views on the low-carbon transition. Different types of investor will respond to the same litigation event in different ways, creating potential market segmentation.<\/li>\n\n\n\n<li><strong>Geography, mandate and institutional characteristics shape how risk is perceived. <\/strong>North America-focused and environmental, social and governance (ESG)-mandated investors assign significantly greater importance to climate litigation, while growth-oriented investors are far more likely to see it as already material. Firms should tailor their disclosure and engagement strategies to their investor base.<\/li>\n\n\n\n<li><strong>Better disclosure could reduce uncertainty and belief dispersion. <\/strong>The structured disagreement among investors suggests they lack common information for assessing climate litigation risk.
