This trend has coincided with a growth in the number of <a class=\"link link--external\" rel=\"noopener\" href=\"https:\/\/climatepolicymonitor.ox.ac.uk\/\" aria-describedby=\"link-description-new-window\" target=\"_blank\" title=\"\">policies, regulations, standards and guidelines&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> that encourage or mandate firms&rsquo; transition to net zero.<\/p>\n\n\n\n<p>The prevailing form of corporate climate litigation has also evolved. Early cases were <a class=\"link link--external\" rel=\"noopener\" href=\"https:\/\/www.cambridge.org\/core\/books\/litigating-the-climate-emergency\/impacts-of-highprofile-litigation-against-major-fossil-fuel-companies\/CE3125C7FFB319C0ECF50CB0059667A4\" aria-describedby=\"link-description-new-window\" target=\"_blank\" title=\"\">backward-looking&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a>, seeking redress for harms caused by past emissions. More recent cases are <a href=\"https:\/\/www.lse.ac.uk\/granthaminstitute\/publication\/global-trends-in-climate-change-litigation-2025-snapshot\/\" target=\"_blank\" rel=\"noreferrer noopener\">forward-looking<\/a>, demanding that companies align their current and future operations with science-based emissions reduction pathways.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.lse.ac.uk\/granthaminstitute\/publication\/global-trends-in-climate-change-litigation-2025-snapshot\/\" target=\"_blank\" rel=\"noreferrer noopener\">Climate-washing and disclosure claims<\/a> often sit at the intersection of these approaches. Backward-looking cases focus on companies&rsquo; involvement in <a class=\"link link--external\" rel=\"noopener\" href=\"https:\/\/climateintegrity.org\/lawsuits\" aria-describedby=\"link-description-new-window\" target=\"_blank\" title=\"\">historical misinformation campaigns&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> that aimed to discredit climate science, which arguably prevented or delayed the introduction of national and international measures designed to reduce the production and consumption of fossil fuels. Forward-looking cases address misinformation such as unsubstantiated net-zero targets or carbon-neutrality claims that could hamper future climate action. In other instances, climate-washing and disclosure claims centre on consumer protection or efforts to counter fraud.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>A lack of progress in forward-looking corporate climate litigation<\/strong><\/h2>\n\n\n\n<p>While <a href=\"https:\/\/www.lse.ac.uk\/granthaminstitute\/news\/climate-washing-litigation-towards-greater-corporate-accountability\/\" target=\"_blank\" rel=\"noreferrer noopener\">several climate-washing cases<\/a> have succeeded, backward- and forward-looking cases have proven to be challenging. <a href=\"https:\/\/www.climatecasechart.com\/document\/milieudefensie-et-al-v-royal-dutch-shell-plc_c3e4\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Milieudefensie v. Shell<\/em><\/a> remains the only forward-looking litigation case to have resulted in a substantive court judgment on the merits, before being overturned on appeal in 2024. The court cited a lack of scientific consensus on company-level emissions reduction pathways and, therefore, an inability to impose a legal standard on the emissions reductions required of an individual company. Nonetheless, it is <a class=\"link link--external\" rel=\"noopener\" href=\"https:\/\/www.science.org\/eprint\/NSXMDBMFPXFWWRRWDWKV\/full?activationRedirect=\/doi\/full\/10.1126\/science.adz4857\" aria-describedby=\"link-description-new-window\" target=\"_blank\" title=\"\">questionable&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> whether the court&rsquo;s conclusion on this fairly reflects the current state of scientific knowledge on sectoral and corporate transition pathways.<\/p>\n\n\n\n<p>In December 2025, a Swiss court <a class=\"link link--external\" rel=\"noopener\" href=\"https:\/\/www.swlegal.com\/en\/insights\/newsletter-detail\/climate-case-asmania-et-al-v-holcim-decoding-the-c\/\" aria-describedby=\"link-description-new-window\" target=\"_blank\" title=\"\">ruled&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> that another high-profile case, <a href=\"https:\/\/www.climatecasechart.com\/document\/asmania-et-al-vs-holcim_f2ce\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Asmania v. Holcim<\/em><\/a>, was admissible &ndash; allowing it to proceed to substantive hearings. In this case, four Indonesian islanders are suing Holcim, a multinational supplier of construction materials, to reduce its emissions by at least 43% by 2030 and 69% by 2040, and to provide compensation for past and future damages.<\/p>\n\n\n\n<p>As more forward-looking cases against companies make their way through the courts and as more countries consider introducing binding requirements for <a class=\"link link--external\" rel=\"noopener\" href=\"https:\/\/www.ifrs.org\/sustainability\/knowledge-hub\/transition-plan-taskforce-resources\/\" aria-describedby=\"link-description-new-window\" target=\"_blank\" title=\"\">corporate transition plans&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a>, the importance of interdisciplinary research into these issues only grows. In particular, there is an urgent need to clarify how to translate political commitments, scientific findings and legally binding goals &ndash; such as the <a class=\"link link--external\" rel=\"noopener\" href=\"https:\/\/unfccc.int\/process-and-meetings\/the-paris-agreement\" aria-describedby=\"link-description-new-window\" target=\"_blank\" title=\"\">1.5&deg;C target under the Paris Agreement&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> &ndash; into concrete, enforceable obligations for individual companies.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Science&rsquo;s role in defining legal duties&nbsp;<\/strong><\/h2>\n\n\n\n<p>Scientific models and emissions reduction pathways underpin climate policy and set out potential versions of our future. But these models do not automatically determine legal standards. In functioning democracies, the law reflects societal values &ndash; including a shared understanding of what constitutes harm and how to attribute responsibility for it. Effective climate action requires sustained interaction between science and the law rather than the unidirectional translation of scientific outputs into legal rules.<\/p>\n\n\n\n<p>In forward-looking cases brought against companies, the courts continue to be presented with <a class=\"link link--external\" rel=\"noopener\" href=\"https:\/\/www.science.org\/eprint\/NSXMDBMFPXFWWRRWDWKV\/full?activationRedirect=\/doi\/full\/10.1126\/science.adz4857\" aria-describedby=\"link-description-new-window\" target=\"_blank\" title=\"\">integrated assessment models&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> that outline pathways companies would need to follow to meet various temperature thresholds (at different levels of confidence). Judges need to determine what these projections demand of firms under the applicable laws. Similarly, legislators and regulators translate climate science into legal boundaries by defining what companies must do in the context of climate change.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The need for interdisciplinary approaches to corporate climate accountability<\/strong><\/h2>\n\n\n\n<p>To date, much of the cross-fertilisation between science and climate litigation has centred on climate attribution science, particularly through <a class=\"link link--external\" rel=\"noopener\" href=\"https:\/\/www.nature.com\/articles\/s41558-021-01086-7\" aria-describedby=\"link-description-new-window\" target=\"_blank\" title=\"\">collaboration&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> between lawyers and climate scientists. This work has been critical in advancing claims related to losses, damage and causal responsibility.<\/p>\n\n\n\n<p>By contrast, there has been far less systematic engagement with social sciences such as environmental economics and political science, despite their central relevance to questions of corporate responsibility, the feasibility of transition pathways, distributional impacts and the political economy of climate regulation.
