The plaintiffs argued that in developing the Food Strategy, requirements to consider how the strategy would affect the government&rsquo;s ability to meet the UK&rsquo;s carbon budgets and net zero target had not been fulfilled. The case was decided on <a class=\"link link--external\" href=\"https:\/\/www.ftbchambers.co.uk\/news\/news-view\/climate-change-court-of-appeal-decides-scope-of-section-13-duty-under-the-climate-change-act-2008\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">narrow statutory grounds&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> but raises further-reaching questions.<\/p>\n\n\n\n<p>We can understand the case as part of a growing subset of climate litigation cases concerned with how the agricultural system, and in particular animal agriculture or livestock farming, contributes to global warming. Animal agriculture generates greenhouse gas emissions at many points in its production processes, from the cultivation of animal feed to the management of animal waste. While it is challenging to pinpoint an exact contribution, animal agriculture is estimated to account for <a class=\"link link--external\" href=\"https:\/\/perma.cc\/MH43-QTQ4\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">11% to 20% of global anthropogenic greenhouse gas emissions&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a>.<\/p>\n\n\n\n<p>The methane emissions produced through ruminant animals&rsquo; enteric fermentation (or digestive process) are particularly significant, accounting for <a class=\"link link--external\" href=\"https:\/\/www.catf.us\/2024\/10\/accelerating-climate-solutions-agriculture-why-reducing-methane-livestock-urgent-opportunity\/\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">over 70% of agriculture&rsquo;s methane emissions&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a>. While <a class=\"link link--external\" href=\"https:\/\/changingmarkets.org\/wp-content\/uploads\/2022\/06\/High-stakes-Part-1.pdf\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">eating less meat and dairy&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> could help to reduce methane emissions significantly, it remains <a class=\"link link--external\" href=\"https:\/\/www.bbc.co.uk\/news\/science-environment-45838997\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">unpalatable&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> for consumers and governments alike.<\/p>\n\n\n\n<p>However, the environmental and climate impacts of animal farming extend far beyond methane emissions, <a class=\"link link--external\" href=\"https:\/\/www.carbonbrief.org\/un-land-report-five-key-takeaways-for-climate-change-food-systems-and-nature-loss\/\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">as the industry drives large-scale deforestation, land conversion and the use of energy-intensive and polluting fertilizers&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a>. Burning forests to clear land for animal feed production and livestock releases carbon dioxide into the atmosphere; but even less devastating forms of land conversion release carbon stored in trees and soils, and simultaneously reduce the planet&rsquo;s carbon sinks. In addition, the production and use of artificial fertilizers, which are heavily relied upon to grow animal feed, <a class=\"link link--external\" href=\"https:\/\/wedocs.unep.org\/handle\/20.500.11822\/46562\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">generate large quantities of nitrous oxide&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> &ndash; a greenhouse gas that traps significantly more heat than carbon dioxide.<\/p>\n\n\n\n<p>Responses to address these emissions are currently inadequate, due to either a lack of regulation or weak enforcement of the regulations that do exist. As a result, litigation has come to the fore as a governance strategy to address this gap.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>An emerging area in climate litigation: towards the &lsquo;Methane Majors&rsquo;?<\/strong><\/h2>\n\n\n\n<p>In 2024, Daina Bray and Thomas Poston published the <a class=\"link link--external\" href=\"https:\/\/journals.library.columbia.edu\/index.php\/cjel\/article\/view\/12548\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">first comparative survey of climate change and animal agriculture&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> litigation, which our dataset builds on. Animal agriculture litigation forms a small subset of cases in the larger climate case corpus at around 40 cases out of roughly 3,000 (the first case was filed in 2010 &ndash; see Figure 1). While most of the cases identified seek to establish accountability for animal agriculture&rsquo;s contribution to climate change, they include a broad range of arguments and types of defendants. As in other areas of climate litigation, we are beginning to see more cases draw on the intersection of climate change and human rights, challenging some of the practices used for animal agriculture on both climate and human rights-related grounds.<\/p>\n\n\n\n<p><strong>Figure 1. This is perhaps unsurprising given these countries are two of the <a class=\"link link--external\" href=\"https:\/\/ourworldindata.org\/meat-production\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">world&rsquo;s largest producers of livestock&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a>. The defendants&rsquo; activities, which include cattle ranching and land clearing for animal crops, are claimed to have resulted in <a class=\"link link--external\" href=\"https:\/\/climatecasechart.com\/non-us-case\/ibama-v-dirceu-kruger-illegal-deforestation-in-the-amazon-and-climate-damage\/\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">climate damage through the loss of carbon sinks&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> and the emissions released from burning forests.
