Given these companies&rsquo; historic, current and future contributions to emissions, these cases are deserved of attention. This represents a marked increase from 2020, when just 22 cases were filed against companies. All but <a class=\"link link--external\" href=\"https:\/\/climate-laws.org\/geographies\/brazil\/litigation_cases\/instituto-preservar-et-al-v-copelmi-mineracao-ltda-and-ibama\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">one&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> of these cases were filed in the United States, Australia and Europe.<\/p>\n\n\n\n<p>Unsurprisingly, fossil fuel companies were the most frequent defendants (Figure 1). Casino<\/em><\/a>, alleging that French supermarket chain Casino&rsquo;s involvement in the cattle industry in Brazil and Colombia is inconsistent with the French duty of vigilance law. Despite the major contribution to global greenhouse gas emissions made by agriculture and land use, action in this important sector has been limited to date. The <a href=\"https:\/\/report.ipcc.ch\/ar6wg3\/pdf\/IPCC_AR6_WGIII_SummaryForPolicymakers.pdf\">IPCC&rsquo;s <em>Climate Change 2022<\/em> report (Summary for Policymakers) <\/a>identified that in 2019 approximately 22 per cent of total net anthropogenic emissions came from agriculture, forestry and other land use, but that this sector had the largest gap in investment for mitigation. Given this ongoing investment gap, we expect that litigation in this sector will continue to grow.<\/p>\n\n\n\n<p>In the plastics sector, <a href=\"http:\/\/climatecasechart.com\/climate-change-litigation\/case\/last-beach-cleanup-v-terracycle-inc\/\"><em>Last Beach Cleanup v. TerraCycle, Inc<\/em><\/a><em>.<\/em> challenged how single-use plastics and other materials that are difficult to recycle were being marketed as &lsquo;recyclable&rsquo;. Claims about biodegradable plastic have also been challenged in <a href=\"http:\/\/climatecasechart.com\/climate-change-litigation\/case\/rosencrants-v-danimer-scientific-inc\/\"><em>Rosencrants v. Danimer Scientific, Inc<\/em><\/a><em>.<\/em> and in a <a class=\"link link--external\" href=\"http:\/\/climatecasechart.com\/climate-change-litigation\/case\/perri-v-croskrey\/\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">stockholder derivative action&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> against the same company. Coca-Cola has been named as a defendant twice in cases relating to plastics, <a class=\"link link--external\" href=\"http:\/\/climatecasechart.com\/climate-change-litigation\/case\/earth-island-institute-v-coca-cola-co\/\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">first&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> in respect of its representations that it is a &ldquo;sustainable and environmentally friendly company&rdquo; despite its plastic footprint, and <a class=\"link link--external\" href=\"http:\/\/climatecasechart.com\/climate-change-litigation\/case\/swartz-v-coca-cola-co\/\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">second&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> in relation to its claims about the recyclability of its plastic bottles.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Two more sectors to note: transport and finance&nbsp;<\/h2>\n\n\n\n<p>Four cases were filed in 2021 in the transport sector. Deutsche Umwelthilfe (DUH), a German environmental and consumer protection association, brought cases against <a class=\"link link--external\" href=\"https:\/\/climate-laws.org\/geographies\/germany\/litigation_cases\/deutsche-umwelthilfe-duh-v-bayerische-motoren-werke-ag-bmw\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">BMW&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> and <a class=\"link link--external\" href=\"https:\/\/climate-laws.org\/geographies\/germany\/litigation_cases\/deutsche-umwelthilfe-duh-v-mercedes-benz-ag\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">Mercedes-Benz&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a>, relying in both cases on the German Federal Constitutional Court&rsquo;s earlier decision in <a href=\"https:\/\/climate-laws.org\/geographies\/germany\/litigation_cases\/neubauer-et-al-v-germany\"><em>Neubauer v. Germany<\/em><\/a>, in which it determined that the country has a limited total CO<sub>2<\/sub> budget remaining at its disposal. DUH claims that in failing to clearly and irreversibly commit to phasing out the sale of cars with internal combustion engines by 2030, which it argues is necessary for the companies to adhere to their allocated carbon budgets, BMW and Mercedes-Benz are violating the fundamental right to climate protection and impinging upon the rights and freedoms of future generations. A <a class=\"link link--external\" href=\"https:\/\/climate-laws.org\/geographies\/germany\/litigation_cases\/kaiser-et-al-v-volkswagen-ag\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">case&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> was also brought against Volkswagen by three youth activists associated with Greenpeace and Fridays for Freedom Germany on similar grounds.<\/p>\n\n\n\n<p>In the finance sector, three cases were filed against private actors last year. These were a <a class=\"link link--external\" href=\"https:\/\/climate-laws.org\/geographies\/australia\/litigation_cases\/complaint-to-ad-standards-on-hsbc-s-great-barrier-reef-ad\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">complaint&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> filed to Australia&rsquo;s advertising standards authority against HSBC challenging misleading statements about protections for the Great Barrier Reef, a <a class=\"link link--external\" href=\"https:\/\/climate-laws.org\/geographies\/australia\/litigation_cases\/abrahams-v-commonwealth-bank-of-australia-2021\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">case&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> seeking the disclosure of climate-related information from the Commonwealth Bank of Australia, and a <a class=\"link link--external\" href=\"https:\/\/climate-laws.org\/geographies\/united-kingdom\/litigation_cases\/ewan-mcgaughey-et-al-v-universities-superannuation-scheme-limited\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">case&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> against the trustees of the UK&rsquo;s largest private pension fund arguing that the fund had been mismanaged, in part through over-exposure to fossil fuels. These cases must also be read in the context of cases against public financial institutions, which have become an important area of focus for climate litigants seeking to achieve broad systemic changes by increasing the cost of capital for high emitting activities (see <a class=\"link link--external\" href=\"https:\/\/www.ecb.europa.eu\/pub\/pdf\/scplps\/ecb.lwp21~f7a250787a.en.pdf\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">Solana, 2021&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a>). These cases reflect the broader global attention on the central role of finance and the finance industry in the transition to a low-carbon economy, particularly following <a href=\"https:\/\/www.lse.ac.uk\/granthaminstitute\/publication\/lessons-from-cop26-for-financing-the-just-transition\/\">key industry announcements<\/a> at COP26 last November.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Where next for climate litigation against the private sector?<\/h2>\n\n\n\n<p>Last year saw the highest number of recorded climate cases against corporate actors. Litigants appear increasingly to be drawing a connection between ongoing public debates about the contribution that individuals&rsquo; consumer and lifestyle choices can make to reducing emissions and <a class=\"link link--external\" href=\"https:\/\/www.cnbc.com\/2021\/08\/10\/the-environment-is-gen-zs-no-1-concern-but-beware-of-greenwashing.html\" aria-describedby=\"link-description-new-window\" target=\"_blank\" rel=\"noopener\" title=\"\">widespread concern&#65279;<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 16 16\" role=\"img\" aria-hidden=\"true\"><path d=\"M14.42 1.04L3.2.7a.8.8 0 00-.8.76v.1a.8.8 0 00.76.7l9.39.3L.93 14.16c-.3.3-.3.8 0 1.1l.09.08c.3.23.73.2 1.01-.07L13.65 3.65l.29 9.4a.8.8 0 00.8.76.79.79 0 00.77-.8L15.17 1.8a.82.82 0 00-.75-.76z\" fill=\"#2e3152\"><\/path><\/svg><\/a> that industry misinformation and inaction may prevent such choices from making a real difference.
