Why research in the jury room is a bad idea

Reacting to the ten questions put by the Vicky Pryce jury last week, the judge, Mr Justice Sweeney, said that the jury had displayed “absolutely fundamental deficits in understanding”. The questions and his reaction received massive media coverage and a great deal of comment.

One of the more reasonable questions put by the jury in the first trial of Vicky Pryce was “can you define reasonable doubt?” To find someone guilty, jurors have to be “sure” of their guilt and judges get guidance as to how they should sum up to the jury from the Crown Court Benchbook issued originally by the Judicial Studies Board.
